I-94 extension question

Hello there,

I'm on an H1-B visa with the following parameters:

  • H1-B Petition valid through Oct-15-2018.
  • Valid Visa stamp with an expiry date of Oct-15-2018.
  • I-94 will be expiring on Dec-18-2017 which coincides with the expiration date of my old passport.
  • Just received a new passport with a validity of 10 years.

I called up the local CBP office and they said they will only correct/replace I-94's with incorrect information, to get a new I-94 I need to talk to the USCIS. Called the USCIS up and the person on the phone just read the info on their website which was no very informative and not clear on what should I be doing to get a new I-94.

Any clues on what should I be doing to get a new I-94? I appreciate your help.

1. Go to the border at Tijuana and make an U turn returning with a new I94 which you ask for.

2. Have your company file a H1 petition for you before I94 expiry.

3. Take a vacation home and return with a new I94.

Make sure your company is aware of the situation.

Can I not go to Canada and reenter US to get a new I-94 since I live in Ohio and the Canadian border is only 4 hours away by car? Assuming that I apply and get approved for a Canadian visitor's visa?

Yes, You can. Call the Canadian Border Force or whatever they are called at your point of entry and point blank and politely ask them if you can access the US CBP without entering Canada as you need a new I94 in view of passport expiry. If they say yes, write down his name again ask politely and do this. If you do not want to do this get a Canadian Visa to tour Niagara and Toronto, maybe to catch the Blue Jays in a game. You should be able to get your visa. YOU HAVE TO ASK for a new I94 when returning whichever way you return. Inform your work Immigration Lawyer about your plans. IS your company aware of the situation?

If you call local CBP officer, they will not extend I94.  I am not sure where you are based.

You can go to either Canada or Mexico border and get it done.

This is what i did.

1.Drove by Car to Laredo, TX and parked in Valero gas station. Paid 5$ for parking fee.

2. Bridge 2 is next to the gas station. Someone in the other forums(*******)  mentioned that try Bridge2 before getting into Bridge1. Bridge1 you will leave US and enter into Mexico and come back to US(all less than a mile). 

3.I tried the option by going to Bridge1, asked the officer who is checking incoming people from Mexico. I told i got new passport and I94 extended. 

4.He took into me the room and asked his higher official whether this can be done. He said YES. 

5. He took old and new passport and checked the Visa number. He gave new I94, took fingerprint and photos. He asked me to pay $6 at the cash counter.

6. I paid cash and came out. The whole process took abt 15 minutes.

Note: I did not leave US,everything is done inside US only. 

7. While coming back on I35E, exit 27, there is a checking, show your passport and i94. This is for incoming vehicles from mexico.

8. The gas station address 614 Hidalgo Street, Laredo, TX.

I went there first week of September. This opens 24/7.
