Kan123 Posted September 12, 2017 Report Posted September 12, 2017 I work on an L1B visa with company X. they recently filed for an extension for my L1B which has been approved. In the mean time Company X had also applied fro an H1B in consulary processing which also got approved. So currently I am on an L1B visa (recently extended) and have an approved H1B on consulary processing. Can I start interviewing to change jobs with this approved H1B, assuming the new employer Company Y can apply an H1B with Cap Exemption. Or do I need to first change my status to H1B by traveling to my home country and getting my H1B stamped. If not, can Company Y apply for a H1B CoS from my current L1B visa which will avoid my travelling to home country immediately for consulary processing. -K
JoeF Posted September 12, 2017 Report Posted September 12, 2017 You need to start working for the H1 employer before a transfer can be filed.
