Raksha SV Posted September 12, 2017 Report Posted September 12, 2017 I travelled to US on F2 visa (Husband on F1) and I am not working. My F2 Visa expires on June 2019. My husband applied for H1B through his employer and it was picked up in the lottery but unfortunately it received a query. His employer is in the process of responding to the same. I have some personal emergency in the family and need to travel to India in the next couple of days . Is it OK to travel now when my husbands H1b query is under process. Would his H1 be abandoned if I travel now. need urgent clarification on this please........Thank you
pontevecchio Posted September 12, 2017 Report Posted September 12, 2017 His H1 has nothing to do with you. If approved you will need the H4 visa to return. If not and he remains in F1 status assuming his SEVIS is intact, you will return in F2 status.

pontevecchio Posted September 13, 2017 Report Posted September 13, 2017 He does not need a H1 visa stamp in his passport for you to get a H4 visa stamp. If a standard company, no problems at all for you to get the H4 visa.
