H1b cap-exempt and validity

Hi -

My H1b was approved in mid 2007 and  valid thru 2010. I went for H1b stamping in 2008. B

ut I never really went to US on a H1b  so I never used my H1b.

Note, I visited US on a B1 (so when I went for the interview my H1B stamping got cancelled by stamping "Cancelled with out Prejudice").

Can i still make use of my approved petition under cap exemption, since I've never traveled on H1B and the petition got expired.

If I re-apply for H1b will I be cap-exempt. How will be my application be treated.

I do not have any documents of my previous petition with me. What can I do here if I were to apply for H1b under cap-exempt. Many Thanks in advance.
