green.ark Posted September 11, 2017 Report Posted September 11, 2017 Hi All,My current H1 visa is expiring Sept 30, 2017. My employer (same employer since 2012; I140 approved) filed H1 extension in July 2017 and got an RFE with an issue with LCA. The attorney/employer says we need new LCA to address this issue. So I just wanted to check if we can submit another H1 extension with new LCA from the same employer and then withdraw the current one? Will there be a risk of going out of status during this process? Also, is it a general norm that the applicant will be asked to go for a stamping if the new extension is approved? Please help!Thank you!

Neda Posted September 25, 2017 Report Posted September 25, 2017 I think you can file a new petition. VISA interview is required if your new H1 doesn't come with I94.

And demanding something as "a priority" is not how to do things on a free forum. You get what you pay for... If you need something urgently, you should schedule a consultation with a good immigration lawyer.
