My university filled my form for OPT and sent all of my documents to the USCIS on June 2017. On August 31, I got the response as OPT Denied the cause it : My DSO did, OPT recommendation into SEVIS on May 12th, but my application wasn't received by USCIS until June 14th, which is out of the 30-day window in which applications must be received after the OPT recommendation has been done. We didn;t know these things before and all the documentation and filling the form and sending it to the USCIS was done by the university, I mean university is fully responsible for my OPT denied cause they didn't send my application in time. I'm working in CPT now, they just updated my I20 to my previous (before we applied for OPT )I20 on Saturday. I applied my OPT to get it before my CPT become 1 year. So, now, Can I reapply my OPT? Can I re -appeal the my old OPT case ? My latest I20 will expire on this December. My H1b has also picked but I haven't got any response yet, no any RFE also. It's already sep=11 today, does that mean I do have less chance to get RFE and high chance to get H1b approval ? Please suggest.
JoeF Posted September 11, 2017 Report Posted September 11, 2017 That looks like CPT abuse. Since you have completed your degree, you can't get CPT.
