charu90 Posted September 10, 2017 Report Posted September 10, 2017 Hello Sir/Madam, I am currently working for employer A on L1A visa, expiring Jan 2018 and i filed H1B with COS through employer B. My H1B petition is picked up in lottery and got an RFE on August 2017 and employer B is yet to respond with evidences to USCIS. Assuming my H1B visa approval delays post October 1st, if my employer A also files L1A visa extension while my H1B petition from employer B is under RFE or approved state , would there be any risk in filing L1A visa extension? or H1B visa processing? Or both of my L1A visa extension and H1B visa can go in parallalel, if so please let me know until when both can go in parallel? Appreciate your response and have a good day! Thanks/charu
vincentanand Posted September 20, 2017 Report Posted September 20, 2017 Both L1 extension and H1B processing can go parallel. A person can have any number of visa petitions being processed in parallel. One visa petition will not impact processing of another petition. Your H1B status will become effective only if you join H1B employer and generate payslip.
