kekehiri Posted September 8, 2017 Report Posted September 8, 2017 Hi Gurus, My previous H1B was approved on 10/20/2011, when I worked for a company for 1 year. Then I moved onto H4. I find another job recently and the new employer can sponsor my H1B. Is it mandatory to reactivate the H1B status by filing a H1B transfer before 10/20/2017? My attorney said he can do it after 10/20/2017, I am a bit worried that it may invalidate my previous H1B and I have to apply a new one again. Please help me and clarify this confusion. Many thanks.
JoeF Posted September 9, 2017 Report Posted September 9, 2017 If you have been on H1 in the last 6 years, you are cap-exempt. If you worked until 2012, that's 5 years, so you are good.
