As per now, I am in F1 OPT status which is valid till Jan 2020. Can you please tell me which will be the best case in the given scenarios to change my job? A) Change my job in OPT and wait for H1 to get approved completely, later apply for H1 transfer. B) Withdraw my current H1 case, change my job in OPT and re-apply for H1 next year with new company. C) Be in my current company till RFE gets approved, later on, apply for H1 transfer. D) Any other best possible case. Appreciate your guidance on this.
copco Posted September 8, 2017 Report Posted September 8, 2017 A) You cant do that. You have to work for your company in H1 status to be considered cap counted. Only then can you transfer. B) Possible C) Probably the best option to avoid going through another lottery.

Only then can you transfer. : Is this the requirement from USCIS that you have to work for certain number of days with the company who files your H1 , coz i read a lot of posts where after getting the 797 approval , they got the transfer acceptance before 1st Oct .
