Mooglee Posted August 24, 2017 Report Posted August 24, 2017 Hello, I got an approval for my H1B extension today with validity upto Aug 2020. My H1 Max out date is Aug 2019 as i started my initial H1B on Oct 1st 2013. I got my PERM approved in 2015 but my I 140 is denied. Is it legal to stay for me till 2020? or Should i leave the country by 2019 max out date? I am planning to re apply for my I 140 But just wanted to get an opinion from experts here.
preety84 Posted August 24, 2017 Report Posted August 24, 2017 @Mooglee i see you had posted earlief in separate thread about 2 RFE's received so looks like now your RFE are clear and got extension - congratulations.. would you mind sharing what your LCA job title/soc code is and what wage level/salary? Seems like you did not get any RFE for wage level which most people are getting. Would appreciate your help! for your question: since it's approved till 2020 I think you can legally stay till then
venkatv14 Posted August 26, 2017 Report Posted August 26, 2017 Hi Preety84, I am in similar situation where USCIS gave me one year extra stay than my H1b Max out date. Is it lawful to stay beyond 6 years as I have the extended petition from USCIS.? Could you please share your thoughts Thanks Vnekat
