Is it possible to file the new H1 now i.e in Aug 2011, with a start date of Jan 20,2012.Also i plan to go to India in dec and return on 1st week of Jan.Can i do my h4 stamping in India and then do a COS to my H1 when i am in the US. pontevecchio Posted August 5, 2011 Report Share Posted August 5, 2011 One can have the sponsor file a H1 petition up to 6 months before the start date. If you are leaving and coming back then come back on the H1 visa. Link to comment
