H1B extension in 9th year with I140 from old employer

Hi, 

I joined my current employer in my 6th year of H1B. Since I had approved I140, I got 3 years of H1B. Now I am in 9th year and my current employer has not filed my I140 yet. Below are my questions

1. If I extend my H1B with current employer, Would I be eligible for 3yrs based on old I140 ? 

2. If I transfer my H1B to new employer with the old I140, would I be eligible for 3 year extension? I am planning to move from full time to consulting firm.
