vinok Posted July 24, 2017 Report Posted July 24, 2017 Hi, I'm stuck in a rather strange situation and any advice would be much appreciated. My current H1B is held by Company A, where i gave a 2 week notice starting last week. Company B started the h1b transfer process on 19th of this month and i only have the Fedex receipt, not the USCIS receipt. Can i join Company B with just the fedex receipt ?, their attorney says it is fine to do so .., but i'm worried.. My second question is that, there might be a one week pay-period, which i'm unable to avoid, because Company B wants me to join immediately as the work load is increasing day by day? Will this be ok ? Will i have issues with my W2 form on tax filings for this one week ? Please advice.

abhi5025 Posted July 26, 2017 Report Posted July 26, 2017 I am in the same boat as well. You are legally good to join company B once you receive the Fedex receipt. I got the confirmation from legal team of my new employer. So, you should be good. Not sure about overlapping pay period though. However, I know that H-1 permits you only for 40 hours of work. Make sure you check that box.
