kkb1 Posted July 19, 2017 Report Posted July 19, 2017 Hey All, I am thinking of taking full time and I have an amendment RFE pending with my current company. What are all the issues I might run into? Also, does my future company need to maintain the prevailing wage (GC labor cert) mentioned by my previous employer. My new company is planning to apply for my new GC as I move in. satya2k1 Posted July 19, 2017 Report Posted July 19, 2017 Hi KK, your post is not clear. You have a pending RFE for what? H1 or LCA or I-140? Your new employer have to get PWD from the labor department. Wages at new employer are totally independent of previous employer.

To use the same priority date I don't have to maintain the prevailing wage mentioned?

As I said, your new employer have to get new prevailing wages for the proffered job and those are the wages maintained by your employer. Your previous employer's prevailing wages do not apply to new position at new employer. Your priority date will be ported to the new I-140 with new prevailing wages.
