Saif2825 Posted July 17, 2017 Report Posted July 17, 2017 Hello , i have been is Usa from mar 2011 to april 27 2017. In 2016 sep to oct i was out of Usa for 5 weeks. My question will i be eligible to apply for h1b in 2018 since i was out of usa for 5 weeks and didnt use my h1b for full 6 years. Will i be eligible for cap exempt ? Or Will i be eligible for lottery in 2018 or will i be eligible too apply in 2019 ?
pontevecchio Posted July 17, 2017 Report Posted July 17, 2017 Any sponsor can apply for a H1 petition for you after April,27. 2018. Hence realistically 2019. You will be subject to the cap.
