Received revocation notice on my H1B Amendment

Hi All,

As I could see most of the advises/information get from this forum.

Need your urgent help here.

I got H1B in 2015 and stamped visa till Dec,2016, Travelled to US in Nov,2016 and got my visa extension till 2019. in March 2017 I moved to new client and location and file for amendment in premium and it got approved end of March, 2017. In April, 2017 I received NOIR and my employer submitted all the required docs. But in 13th July 2017, I received update in USCIS with revocation notice was sent.Yet to receive notice.

I have some questions here.

1. As my H1B amendment approval is revoked, is my petition is valid now? extension done till 2019.

2. Am I eligible file amendment for same client or different client for different location

3. If petition is not valid, is it CAP exempted.

Your help is really appreciated as I have very less time to take action.

Yes, your petition should be valid

Yes

3. If petition is not valid, is it CAP exempted.

USCIS will send you a notice if they wanted to revoke your petition. If you did not get any such notice your petition should be valid and you can get CAP exempt as well.

When you got the NOIR, what was the reason quoted for revocation? If USCIS feels there is any fraud happening with your amendment filing, there is chance that they would revoke your H1b petition along with your amendment. Else, you should be fine.
