sivakiran Posted July 7, 2017 Report Posted July 7, 2017 i was on L1B from Nov2011 to Nov2016. While I am my L1B I applied for H1B in the year 2015. I got my petition approved by Feb 2016. I travelled back to India by Nov2016 as I have completed my L1b cap which is 5 years. I am in India till Dec 2017 where my cap will be reset. Will I be able to use my H1B for 6 years?
JoeF Posted July 8, 2017 Report Posted July 8, 2017 You would get one year on H1. The clock only resets if you are abroad for a year and AFTER that year, a new H1 in the quota or am L1 is filed.
