Vanditha Posted July 2, 2017 Report Posted July 2, 2017 Hi, I'm working for Employer A on L1B visa. I got H1B from Employer B newly. I would like to know if I can transfer the H1B to employer A. If I can then, do I need paystubs from Employer B? Can I transfer H1B to employer A before October ? Thanks a lot for your guidance, Vandi
agnia123 Posted July 3, 2017 Report Posted July 3, 2017 If your H1B from Employer B is approved then you can show your approved I-797 to your company A and they can start the H1 transfer part. They will file H1 and Change of Status so that you can come on H1b. You don't need Paystub from Employer B. Anyhow your H1 transfer will not be approved soon due to unavailability of Premium Processing. But I am not able to understand, why do you want to come to H1B for same employer, there is not added advantage of H1B other than job change. With L1B you have added advantage that your spouse can work legally on L2 Visa but not in H1B.

Thanks a lot for your guidance, Vandi You can not transfer H1b to employer A without start working with employer B. There is no way you can transfer H1b before October.

But H1 is needed for GC processing. Like a loop. And yes, agree L1 is better when spouse want to work.
JoeF Posted July 4, 2017 Report Posted July 4, 2017 Once you started working for the H1 employer from Oct. 1 on, then you can change employers. It is nowadays not possible to change employers before the H1 kicks in on Oct. 1.
