I want to file a Visa and Pay fraud case on my Employer

Hi ,

i want to file a case on my current employer for Visa fraud and Pay fraud .

my employer keeps a portion of my earnings(MY LCA pay is 60K but i earn around 95K) with him in every pay check, so that he can run the pay check when i am on bench or in between projects.

from past 3 years i never been on bench, so i asked him to pay my balance money which he keeping with him. Now he is not answering my phone calls and not replying to my emails regarding this issue. more over he is charging me with ridiculous amount of fees  for my H1B extension and amendments.

He also owes me money personally. 

now i am afraid that he is not going to run my paychecks in coming months.

i don't mind going back to my home country if something happens to my H1B visa status. But i want this kind of fraud Employers to be punished. so that no other person wont go through this kind of fraud issues.

i need your suggestions, how to address this issue . can sue my employer on this basis ?
