Krishan Kumar Posted January 13, 2017 Report Posted January 13, 2017 Hello, I have valid I-94 but expired 1-129s and expired visa.I got L1-B visa in Dec-2013 and it got expired in Dec-2016. In Nov-2016 I went outside US for vacation and reentered in Nov-2016. On my arrival I got extended I-94 which is valid until Nov-2019. My question is if I can stay in US legally and continue working? The I-797 is valid indefinitely.Going thru similar posts my understanding is that it's valid. I need lawyer confirmation just in case laws and norms got modified recently. Thanks! Krishan.
pontevecchio Posted January 13, 2017 Report Posted January 13, 2017 Lawyer confirmation will involve a lawyer consult and is not possible in a forum. If your L1 is a blanket L1 then you can of course stay till 2019, subject to the 5 year total limit for L1 status. Hence you seem to have got an extra year and you should bring this to your companies attention.
mdevananth Posted January 13, 2017 Report Posted January 13, 2017 Yes you can. But I assume that you have not exceeded your max limit of 5 years in your L1 visa. I was in a similar situation and I stayed in US just with my valid i-94. But I was on my 4 year of stay in US and I got my h1 towards end of year 4. For a period of 11 months (beginning of year 4 till end of year 4) I was without any valid visa and just stayed with my valid I-94. I also got my extended I-94 on my return from vacation in year 3!
