My situation : I have completed 6 years of stay in USA on my H1 and i am in my 8th year now. Currently I have my H1 and an approved I-140 with Employer A which is valid until Mar'18. My spouse has obtained a H4 EAD based on this i-140 and is employed at this point. Scenario : If I now change my employer, my understanding is that my H1 will get transferred to the new employer and say I get an extention of 3 years at the time of transfer based on my current valid i140. This would leave me with a valid H1 for 3 years and an older i140. Question If my future employer(EMPLOYER B) is yet to apply for my i140 but my older employer(EMPLOYER A) files to revoke my valid i140. 1. Will my spouse be out of work permit(H4 EAD) until my i140 is applied and approved by my new employer(Employer B)? 2. If my new employer applies for an i140 immediately after joining, is there a way my spouse can continue working on H4 EAD based on the new application even though the older i140 is revoked.
