RaviK Posted January 12, 2017 Report Share Posted January 12, 2017 Hello Experts My H1B /I-94 visa expired in Dec 2016 and my current Employer A has already filed for an extension in November,before the date of the expiry, under normal processing. I am waiting on the status. Got an offer in the meantime from another Employer B I recently interviewed with. I have the following questions. (i) Should I ask my current Employer A to convert the normal processing to premium processing and get the extension approved before B could file the transfer petition? Or could B be able to file the transfer petition in parallel? (ii) Would I get a new I-94 for the new petition filed by B? (iii) Assuming the petition of B gets approved before the extension request filed by A is approved/denied, what should I do? (iv) Should I go back to my country of nationality to get the H1B visa stamped again for any scenario? What exactly should be the approach from me here? Kind Regards Link to comment

Kind Regards i) Looks the better option to me. ii) Yes iii) Do option (i) iv) No legal need unless you want to have the privilege of having a Visa in hand which enables you to travel out side of the USA without much concerns during return.
