My employer applied and received approved I-140. I came to know from online news papers, that a new bill is brought in to reform H-1B visas which would require workers on the H-1B visa pay a minimum of $100,000. The bill also removes the Master's degree exemption to the cap on the number of visas available. My question is, if the all above proposals in new bill becomes a law: 1. For all existing H1B holders, do all of them need to qualify/ to have masters/MS to continue to work in US if new bill is passed? Since I do not have masters degree, should I consider to pursue MS/master degree ahead of time? 2. Will the new rule apply on new/fresh applicants? Can it be applied on existing visa holders (including those who applies for H-1B transfer to change employer)? Please let me your opinion and thoughts based on current information. Regards, Ray.
JoeF Posted January 12, 2017 Report Posted January 12, 2017 These "online newspaper" journalists are clueless and don't know anything about the immigration laws. This bill is about H1-dependent employers. Currently, H1-dependent employers have to pay their H1 employees a minimum salary of $60K, except if the employee has a Masters degree. The bill would increase the minimum salary to $100K and remove the exception for people with Masters degree. But again, this is only for H1-dependent employers, like some consulting companies. Find a real employer.

It does not mean that, all H1-B holders have to have master's degree in order to be hired or continue to work with H1B status in US in future? For example, I do not have masters degree and working on H1B visa. So, my question is, do you think that, if, current proposals becomes a law, can I continue to work with H1B visa with my employer or any employer in US with my current bachelor degree? If I want to change the employer, will the new employer hire me without a masters degree? I am looking forward for your valuable understanding on this bill as it has been presented. JoeF Posted January 13, 2017 Report Posted January 13, 2017 Again, this has nothing to do with the general H1, this has to do with the minimum requirements for filings from H1-dependent employers. And it also doesn't mean that people on H1 need to have a Masters.
