H1B cap exempt with I140

Hi,

currently i am in L1A visa and it is valid till April 2017. Till last year i was in H1B and my employer filed GC in EB2.

Now my I140 approved last month and my employer initiating H1B cap exempt (non premium)

Question.

Is it possible for the new employer to fill H1B cap exempt with my approved I140 of current employer or it is not possible she nce currently in L1A.

Please advise
