radsamshop Posted January 6, 2017 Report Posted January 6, 2017 Hi All, i transferred my h1b to company B(working with company B and have payslips) from company A (i am on long leave with company A, they are not running my pay roll, My h1b and i-140 is still active). now Company B is not willing to do GC process. Can i go back to company A since my 1-140 is active? If yes what will be the process. thanks in advance.
pontevecchio Posted January 10, 2017 Report Posted January 10, 2017 If A wishes, they can file a H1 petition for you and get it approved before you join them.

pontevecchio Posted January 10, 2017 Report Posted January 10, 2017 Long leave is an alien concept here. Ideally they should have revoked your H1 petition. Even if they did not they should file a H1 petition for you and you can join on approval.
