Completed 6yrs in US on L1 & H1, after cool of Out of Cap applicable?

I stayed in USA on Blanket L1 Aug2005 to Nov2007 and Dec2007 to Oct2009 on regular L1 and Oct 2009 to Jul 2011 on H1b.(no H1 stamp) utilizes i-94 received along with petition. Now am eligible to apply H1 on out of cap?

You have to apply H1b through CAP only.

Time on L1 and H1 is combined. If this adds up to 6 years, you have to stay abroad for at least a year and then a new H1 petition in the cap can be filed.
