avip5 Posted January 3, 2017 Report Posted January 3, 2017 Hello, I previously worked on H1B visa for 3 years and converted to H4 in the year 2016 and I am currently working on H4 EAD(my spouse has approved I-140). If I want to convert back to H1B visa, will I fall under the H1B CAP or can my employer directly apply for H1B visa at any time. And will I be able to use my 3 previously unused H1B years after converting to H1B. Please help me understand the process.
vivek123 Posted January 3, 2017 Report Posted January 3, 2017 As per my understanding you need to apply for new H1B, since you utilized all 6 years of your H1B.
