WorkVisaTraveller Posted January 3, 2017 Report Posted January 3, 2017 Hi, I am working with Company A. My I-140 is approved in May 2016. My 6 years on H1B will expire in Nov 2017. I may get laid off Jan-Feb 2017. I may join Company B in Feb/Mrch 2017 , I can get 3 years of extension. Now , Is it mandatory that Company B has to file my Greencard within 3 years ? What If something does not work out at Company B and I need to join company C in any time between Feb 2017-Feb2020 . Can I get another 3 years of extension with Company C if Company B does not filed Greencard and I dont have I140 approval with Comapny B? Thanks.
pontevecchio Posted January 4, 2017 Report Posted January 4, 2017 As long as you have an approved I-140 which is not revoked, you can get 3 year extensions of H1 till the PD is current. A 3 year extension thus granted remains valid even were the I-140 to be subsequently revoked and you can potentially work for different employers during the 3 years. But subsequent extensions are not possible unless your PERM is pending 365 days or more or you have an approved I-140.
