Ravi V Posted January 1, 2017 Report Posted January 1, 2017 I have applied for H1b with employer 'A' in 2014 and it got picked in lottery and the petition was approved. Till now I havent used the petition and gone for stamping yet. Currently I am still in India and I have requested employer 'B' to initiate the H1B petition transfer to employer 'B', it has been applied with normal processing to USCIS in may 2016. Till now there is no update from USCIS yet, but my petition is valid till Aug 2017 only. My query here is If my petition is approved in next few months onto employer 'B', will the validity extend or it will still remian the same Aug 2017. I also requested my employer 'B' to initiate transfer now with the premium process(upgrade option of processing). Just need to understand the validity of my petition on how it will be applicable.Also if my transfer is done will the validity still remain the same / or before the existing validity I need to be in US and file for extension, once the petition is approved onto employer "B". Kindly request you to share your inputs in this regards. Thanks in advance.
