vig Posted December 29, 2016 Report Posted December 29, 2016 Hello, I need a help in making a decision. My company is going to file I-140 on my behalf in next couple of months. They have asked for detail of my dependents (wife and children). I have 2 children, my elder one is doing his under-graduation in India, where as my younger one is with me in USA studying in High school. I know, my PD will not be current in next many-many years, and by that time my elder child will complete his under-graduation. He wants to pursue his MS / PHD in USA, he is already preparing for GRE. My question is, if I add my elder child's name in my I-140, will he get any problem while applying for his F1 in India, say after 2 years. Will USCIS consider my son as "intent to migrate" and F1 may be denied? Please advise. Thanks VG
shekar11# Posted January 3, 2017 Report Posted January 3, 2017 Your dependents will not be added during I-140 process. They will be added to the I-485 application when you PD is current. Don't worry too much.
