H1B Stamping in Calgary

Hi,

I have attended the Visa interview for my H1b stamping in Calgary on 14Dec16 and I was issued with 221g

VO: Can I have your passport and I797

Me: I gave

VO: Is this your first H1b

Me: Yes

VO: where do you work

Me: told

VO: What are your job duties

Me: Told

VO: pulled a yellow slip 221g gave it me and asked my CV and said I couldn't find any flaw in the documents but this is a general procedure. You will receive a communication from the consulate for Administrative processing.  I asked how log this procedure will take and she responded few weeks to months. And initial communication I will receive in 7 to 10 days. I have not received any communication yet.

11.  How long this process will take ?

22.  Is there a way we can expedite this process or get the updates about my application 

33. What kind of reasons will impact to take much longer time for processing of this 221g Administrative process ?

44.  I have a personal work in India by End of Jan can I travel to India and still keep this process continuing in Canada ?

55.  Do I personally have to stay in Canada or it is not required ?

66.  My job is a commute job right now Can you please confirm if I can still do the work once I go to India or is this violating any of the H1B clause ?

77.    If I travel to India how soon can I apply for new H1B with a new employer ?

88.    Does this 221 g will have any impact on the H1B that I will be applying with another employer ?

99.    Is there any time stamp to work from home in Canada ?

110.   Impact on H4 Visa ?

111.    H1b Transfer impacts in future ?

  12 How are they going to communicate with me ?

 

   Please help me in getting more information. I am still not sure what needs to be done.

       As the VO said few weeks to few months. Generally it should take 3 to 4 weeks.

      No.

      Each application takes its own time no predictions on what they want or how they want it. If they have contacted your client and your client gave response back then it is just a waiting game.

      You can always go to India. The process here will still keep going.

55.  Do I personally have to stay in Canada or it is not required ?

      Not required as long as they don't ask you to come for a second round of interview. Which I rarely see in this form.

      You can work from where ever you can as long as this H1 is still under review.

77.    If I travel to India how soon can I apply for new H1B with a new employer ?

       Immediately.

88.    Does this 221 g will have any impact on the H1B that I will be applying with another employer ?

      Not necessarily.

99.    Is there any time stamp to work from home in Canada ?

      No.

110.   Impact on H4 Visa ?

       No if this visa gets approved.

111.    H1b Transfer impacts in future ?

       If it gets cleared then no issues. If it gets revoked then what ever the reasons are that will dictate.

  12 How are they going to communicate with me ?

       To the email address given in DS160.

3. I recently got a full time job offer how can I switch the company and apply for a visa interview in India ?

4. Do I need to travel back and forth from India ?

Yes. Generally they will ask to send it through email anyway. If asked to submit anything in person then you might need to come back.

2. if they ask me for my passport can I send it from India ?

This i am not sure about. Generally the emails states how to submit the passport. Some tines they will ask you to submit in person. So be prepared to travel back.

3. I recently got a full time job offer how can I switch the company and apply for a visa interview in India ?

You can apply for a new H1. As long as they dont withdraw your old H1 you can use it to travel back to US on the same visa.

4. Do I need to travel back and forth from India ?

Once this visa is approved you can travel back with it.

1. As I got this full time job offer, can I take it and do the H1b transfer to the new company and attend the visa interview in Hyderabad ? As you are aware that my previous consultant H1b is under 221g Administrative processing. while it is in Administrative processing can we do the H1b transfer and attend the visa interview in Hyderabad ?

2. Can I travel to US while my application is under 221g Administrative processing ?

I have received a mail which has the below content.

Questions:

1. Which location the passport has to be sent  is it Calgary or Toronto ?
