ravi678 Posted December 27, 2016 Report Share Posted December 27, 2016 Hi, My lawyer together filed my I-140 (Processing at Nebraska center) and my wife's I-765 (Processing at Vermont center) for EAD. We got a RFE for I-765 which asked us to submit approval notice of I-140 BUT I am still waiting for I-140 to get approved. My lawyer is saying to reply a RFE with pending I-140 notice and then wait for the result which may be positive or negative. What should I do now? Thanks Link to comment
JoeF Posted December 28, 2016 Report Share Posted December 28, 2016 That EAD will get denied. It can only be filed when the I-140 is approved. Find a better lawyer. Link to comment

The EAD would still get denied because it was filed before the I-140 was approved. An H4 EAD requires an approved I-140 at the time of filing. Link to comment
