Kris01 Posted December 23, 2016 Report Posted December 23, 2016 Hi, I was working with company A in US between 1996 to 2000 on H1B visa. I have an approved I140 with priority date Feb 2001. The company A no longer exist but my approved I140 has not been canceled or revoked. I am currently working in India. Can I use my approved I140 to file H1B Transfer under cap exempt with a new company being in India? I still have more than a year left on my H1B as i have not completed six years on my old H1B. I would appreciate if anyone can answer my query ASAP Thanks
JoeF Posted December 23, 2016 Report Posted December 23, 2016 If the company no longer exists, the I-140 is automatically canceled, as far as I know.

I suspect you will not be able to get further extensions as the I-140 is redundant in view of the company closure. You may like to discuss the matter with the firm of Murthy or any of your choice.
