H1-B - Current company in Inida not giving I797 Copy

Hi,

I am working with my current Company in India who had filed by H1B Visa. H1B Status as per USCIS website is Approved
and Approval validity date is till 31st Mar 2018. I did not get USA Onsite opportunity with my Current company
and now I have resigned from the company,H1B is not stamped. Current Company is Not giving my I797 copy to me and they are telling me to pay the H1b visa fees for it.
1. Can I get job in USA with just Receipt No(EAC no) or I need to pay Visa application fees to my current company?

2. If I pay to my current company and got the I797 copy Can I find the job in USA on that basis? If yes how?

The company has to pay the H1 fees, by law. If you pay, you would only make things worse.

And a company in another country can't file an H1, only a US company can.

You can not use that H1, since you haven't worked for the company in the US.

Next year, find a better company.

I think if you have Petition number and if this is approved, new company can file H1B transfer ( H1B change of Employer). Please consult with attorney on this.  Please try to find new employer in India having presence in US.
