igen2012 Posted December 21, 2016 Report Posted December 21, 2016 I read per this rule that'll be effective from 17th Jan 2017: "One can still use the previous employer’s I-140 approval to extend one's H-1B with a new employer even if it is withdrawn (as long as it was withdrawn more than 180 days after approval). " Have the following query with respect to the H4 beneficiary of a H1B holder whose I140 has been valid for 6 months as on Jan 17th 2017. 1. Does the rule also mean that in the following scenario H4 EAD can be filed? I140 has been valid for more than 6 months as of Jan 17,2017. The H1B employee changes the job on Jan 17'2017. I140 revoked after Jan 17 ,2017 by the previous employer. Can H4-EAD be filed after this I140 has been revoked by the previous employer? 2. For application of EAD for H4, is the receipt number of approved I140 from previous employer sufficient OR is the approval notice of the I140 a necessary document? Thank You.
