SCENARIO: She has 10 years visitor visa, when she came to the US she got 6 months stay initially, at the end of her stay she went to Canada to re enter the USA, while re entering the visa officer granted her another 6 months stay BUT verbally told her that she should leave in 2 months. I checked her I 94 online and did not see any notes from the immigration regarding leaving, and her I 94 is valid for another 4 months.... My question is: Can She live here for couple more months or has to leave ?
JoeF Posted December 20, 2016 Report Posted December 20, 2016 A visitor can never live here. A visitor lives abroad and visits the US. A visitor living here would be a violation of the visitor visa terms. That officer was really nice. Usually, the rule is to only get the original remainder time. A note may be in her file, so it is best to leave in 2 months, otherwise, she may run into issues in later visits. Staying in the US as visitor for one year is already going to raise red flags.
