PdyPar Posted December 18, 2016 Report Posted December 18, 2016 Hello, First Amendment: Last year, I have moved from a state to another state and filed the amendment before I moved. Second Amendment: Then in few months, my work location was changed temporarily to another state and after a month I moved to a new state to work in a long term project. So second amendment + extension was filed before I moved while the previous amendment filed in 2015 decision was pending. Few months back, I had to visit my home country and changed to premium processing and got the approval for second amendment. I visited my home country and got new H1B stamping till 2018 and returned to the state where I am working right now. Now I have received approval for the first amendment we have filed and this petition expires on Dec/31/2016. I have been asked to submit documents to file amendment + extension by my employer. Question: What will happen to the current I94 & visa stamped till 2018? Can I leave and come back to USA with the current visa after I file the extension + amendment? I appreciate any help.
shekar11# Posted December 19, 2016 Report Posted December 19, 2016 You can leave and come back to USA with current visa to avoid any confusions.
PdyPar Posted December 19, 2016 Author Report Posted December 19, 2016 Thanks Shekar. I have an approved petition valid till 2018 for the current location. Since the first amendment is approved after the second, which petition will be considered as latest?
