In the past 5 years, I have stayed out of the US for 406 days but my stay outside never exceeded more than 6 months in one go. I just got back to US a month back after 1 month of vacation. Can I apply now or should I have to wait 3 months since I just got back a month back, please let me know Link to comment
JoeF Posted December 5, 2016 Report Share Posted December 5, 2016 If you have lived in the same district for the last 3 months (vacation doesn't mean that you give up your home), you are ok to apply. The 3-months in the district requirement is not about physical presence. Of course, you have to fulfill the physical presence requirement (1/2 of the 5 years before applying) and the continuous residency requirement. Link to comment
pontevecchio Posted December 6, 2016 Report Share Posted December 6, 2016 If you qualify as per M-476, the relevant instructions, you can apply. Residence is not physical presence. If you had this house/apt for more than 3 months and stayed here and used this address, you are fine. Link to comment
