H1B CAP EXEMPT/ 6 YEARS DEADLINE

Hello,

Could someone help me in knowing the correct information regarding H1B CAP EXEMPT and H1B transfer

I 797 Details Approval 10-01-2007 valid till 09-16-2010

VISA Details 23-NOV-2007 valid till 16-SEP-2010

I came to USA on 09-APR-2008 and returned back to India on 31-MAY-2010

Now again i want to come back  to USA using the same H1B .Am i eligible for CAP EXEMPT or do i have to apply for fresh H1B application.

Also can i have H1B transfer from Employer  to Employer B.

Kinldy help me iam getting different answers .Can anyone help me in getting the corrrect information for me.

You are eligible to reclaim 4 years in total with no single period more than 3 years. You need a sponsor to file a non cap H1 petition for you and get it approved and then you get the visa stamp and come over.
