Pavani Posted November 23, 2016 Report Share Posted November 23, 2016 I was on H4 until April 2016 and in April we have applied H1B and it is not approved yet ,it is in RFE state , What is my current visa status is it on H4 or H1B ? If USCIS has not approved H1B by default it goes to H4 or do I need to explicitly amendment for H4 ? My Husband is applying I140 on premium processing which will get result in two weeks and I would like to move on H4 EAD . What is my best way to change my visa status with H4 ? My Employer needs to revoke H1B to change to H4 ? Can you please provide your suggestions ? Thank You Link to comment

pontevecchio Posted November 30, 2016 Report Share Posted November 30, 2016 Until the H1 petition with COS from H4 is approved, you remain in H4 status. If the H1 petition is denied you continue to be in H4 status. If the H1 petition with COS from H4 is applied you will go into H1 status. Link to comment
