sumanth mylar Posted November 22, 2016 Report Posted November 22, 2016 Hi Team, I currently hold an valid H1B (picked in 2016 lot) and stamped from Company A. I have not travelled to US from the current Company A and currently in in India only . Now I have got an offer from Company B and they say that we will transfer the current H1B. Is there any a situation where USICS can decline this transfer and cancel my current H1B and can Company A raise an objection with USIC to cancel my current H1B . I have all the H1B docs (original petition copy and other supporting documents) . Thanks !! Sumanth N Myalr
pontevecchio Posted November 30, 2016 Report Posted November 30, 2016 Firstly the rules seem to have changed with one exception. If you get a visa stamped for the Original sponsor, you are able to get another sponsor to file your H1 non cap. Otherwise "transfers" are only allowed if you first work for the original sponsor. Secondly it is not a "transfer" in the sense you mean. The petition from B will be decided on merits. Make sure you are not getting blinded by consultants who promise you the moon and ask for advance money for filing. By all means have B file as you do know you cannot pay for the H1 and if approved go and work for them. Please MAKE SURE that you return to this thread and tell us what finally happened .
