EB1 eligibility

Hi,

I worked for my employer in India for almost 10 years, but only 11 months 4days on a Managerial role. I quit and came to US on H1B through a different employer. Now I joined back my previous employer in US on a managerial role again and my employer is ready to process my GC. Now my questions is, will that 11months 4days be any issue if all other criteria is fine to become eligible for EB1 category?

 

Please clarify!!

Multinational manager or executive

You must have been employed outside the United States in the 3 years preceding the petition for at least 1 year by a firm or corporation and you must be seeking to enter the United States to continue service to that firm or organization. Your employment must have been outside the United States in a managerial or executive capacity and with the same employer, an affiliate, or a subsidiary of the employer.

Your petitioning employer must be a U.S. employer. Your employer must have been doing business for at least 1 year, as an affiliate, a subsidiary, or as the same corporation or other legal entity that employed you abroad.

Thanks for the response. I went through all that. But still that 1year outside US in managerial role is my concern here. I'm short of few days. So, wondering if that would be a problem.

 

If anyone know, please confirm.
