nnsuresh Posted November 17, 2016 Report Posted November 17, 2016 I got my H1B visa stamped in 2008 valid for 2008-2011. i.e visa expired in 2011 sep. I never traveled on this visa. But traveled on B1 few times to US. total 160 days. Now i am interested in using this H1b visa as i got good offer in US. Kindly let me know weather my H1B visa can be renewed now. If so how many years i can be stamped for i.e only 3 years OR 6 years. Thanks Suresh
pontevecchio Posted November 17, 2016 Report Posted November 17, 2016 You may be able to be considered cap counted. Since many rules have changed, first consult the firm of Murthy or any of your choice and then approach H1 sponsors. H1 petitions are for a maximum of 3 years at one time.
JoeF Posted November 17, 2016 Report Posted November 17, 2016 Since the H1 was filed more than 6 years ago and you never used it, it is not possible to get a new H1 based on it. A new employer can file an H1 for you in next year's quota, for a start date of Oct. 2017.
