psm_hope Posted November 16, 2016 Report Posted November 16, 2016 Hi Team, I have one question, please see below: I had my H1B transfer denial in month of June 2016 and I had to come back to my home country. Now, I found one new employer who is willing to file my H1B petition in premium processing. Do I need to inform them about my last petition denial? If I do, Is it mandate to mention my last petition denial while filling new H1B? I didn't stayed in US unlawfully. I was present in US till my last date of I-94. And I was out of status only for 5 days which is negligible. Still we need to mention about my last H1B petition denial explicitly in I-129 form? Please clarify my query asap. Appreciate your timely response. Thanks
