Krishna.Sagar Posted November 13, 2016 Report Posted November 13, 2016 Hi With my current employer, I have I140 approved on date May/22/2014. My 6 years of H1B term is completed, the current H1B was approved based on the I 140, H1B status is valid until Nov 2017. Now I have another full-time job offer, I am not sure how should I prepare for this situation. Following are my questions preparing for the worst... 1. Knowing the news of changing employer, my current employer will revoke my H1B and withdraws my I140. Within 60 days of H1B revoke, if I manage to get my new employer file new H1B, will I be able to retain my H1B status and eligible for 3 years of H1B using withdrawn I140 ? Basically, how should I be prepared for this transistion 2. Typically how long will it take for an H1 revoke to take effect ? 3. If my employer withdraws my I140, will there be any impact retaining my Priority Date while restarting the GC process with new employer? Thanks, Krishna
