H4 EAD (7th year H1B - AC21), No I-140

Hi,

I am on my H1B (7th year extension) based on an approved I-140. I am planning to change jobs in the next couple of months after which my current company will revoke my I-140. My wife who is planning to join me in February next year will travel on H4. Can I file a H4 EAD for her then when my old I-140 is revoked by my previous company but I am on an H1B with the new company?

Your help and guidance in this regard is much appreciated.

You need an approved non revoked I-140 before she is eligible for applying for an H4 EAD.

Thanks pontevecchio, what happens after today's USCIS announcement of I-140 being valid even when revoked by employer after 180 days of being approved?
