ranga_cit Posted November 11, 2016 Report Posted November 11, 2016 Hi, I am working on applying for concurrent processing of I-140/I-485 along with my wife (she is applying as my dependent). She is Canadian by birth. I am on H1B and PD is current through Canadian cross-charging She entered in F2 status (with stamping at port of entry), changed to H4 COS and she has got a job now, for which TN COS is being prepared (premium processing). We plan to delay filing I-140/I-485 till TN COS is approved. Two questions: 1) Is it OK for her to be in TN category, when our I-485 is filed? It is a non-immigrant category, that's why asking? 2) In Nebraska processing center, how long does it take to get EAD after I-140 is approved (for a pending I-485)?
pontevecchio Posted November 12, 2016 Report Posted November 12, 2016 TN status does not allow for Immigrant intent. Please help yourself and talk to a Lawyer before you make major errors of judgement.
