The question i have as i have an approved I140 since 2012 and now i am planning to change my job with the new company but my employer is not ready to give me the original I140 but it is the requirement from the new company that employee should have the original. Also, would my employer be able to withdraw my i140 ? I was reading online about it and found some articles which say that if your petition is approve for more than 6 months then your employer can not withdraw and your Priority date is locked which you can port to new i140. Could you please let me know if that's the correct understanding
maram Posted November 20, 2016 Report Posted November 20, 2016 Hi As per my knowldge employer can withdraw the i140 at the same with reciept notice you get a copy of i140 from uscis . New rule which will be effective from Jan17th employer can withdrwa but it doesnt affect your i140 revoke. so wait till jan 18 2017
pontevecchio Posted November 20, 2016 Report Posted November 20, 2016 Once an I-140 is approved, it is generally available for PD retention with any other employer. The I-140 can be revoked any time.
