SrinivasanN Posted November 11, 2016 Report Posted November 11, 2016 Hello, I am on a L1-A VISA (Managers and executives) and in theUS 12:02 pmI got my I-140 approved and have filed I-485 with USCIS -- getting the biometrics scanning done in next few days. Now, the stamping on my Passport (VISA) is up to mid April do I need to apply for a extension of L1 VISA now?
JoeF Posted November 11, 2016 Report Posted November 11, 2016 The visa is an entry document only. For non-immigrants in the US, the I-94 determines the allowed stay. A pending I-485 allows you to stay. When your I-94 from the L1 expires, you need to extend the L1 or get an EAD. To travel, you need AP.

My I-94 stamping is till 22-Apr-2017 3. My I-485 is pending with USCIS as of this date (filed early October) and I will get the biometrics screening done this week 4. With the above, Do I need to apply for a VISA extension (to take care of the VISA date in the Passport stamping, and the I-94? Thanks for all your help.
pontevecchio Posted November 15, 2016 Report Posted November 15, 2016 ASK your company Lawyer whether EAD/AP have also been filed as once you get EAD/AP, you do not need to maintain L1 status. I would remind you the company files a L1 extension and not you. Hence communicate with the company Lawyer/ HR/Your future supervisor.
