Can a L2 Visa Holder stay in USA without L1 for few weeks

Hi,
I am on L1 visa with my wife. She is with L2 visa. I have to go to India to renew my passport. This will take typically 3 to 4 weeks. If I am still getting paid by the company I work in USA when I am in India, can my wife stay in USA.
